Maryland's First Class Action Suit Against St. Joseph Medical Center for Unnecessary Stent Procedures

Claim alleges doctor performed unnecessary cardiac catheterization procedures with stent placement and St. Joseph engaged in fraud, etc.

(Baltimore, MD - January 28, 2010) Murphy P.A. and the Law Offices of Peter Angelos, P.C. of Baltimore have filed a class action lawsuit on behalf of patients who underwent unnecessary invasive cardiac procedures at St. Joseph Medical Center. The suit contends that Dr. Mark Midei performed hundreds, if not thousands, of unnecessary cardiac stent procedures on patients as revealed by a federal investigation.

To ensure the immediate safety of patients, Murphy P.A. and the Law Offices of Peter Angelos, P.C. have asked for an injunction:

  1. Stopping the hospital from performing any further cardiac catheterization procedures without third party peer review unless there is imminent need;
  2. Requiring the hospital to provide full medical insurance coverage to all of its patients who lost their health insurance or became uninsurable because of the performance of unnecessary cardiac catheterization procedures; and
  3. To pay the costs associated with the review of plaintiffs' catheterization procedures.

“This is the worst abuse of the public trust we have seen in recent memory by a hospital in which patients place their confidence in seeking care and treatment,” said William “Billy” Murphy.

Murphy added: “It is unfortunate that an institution such as St. Joseph, which has served so many people so well for so many years, would have allowed such a practice to have occurred.”
